About The Settlement

Why did I receive this payment?

Your settlement payment is the result of a settlement in the Tyson v Shack Shack Enterprises LLC Settlement.

Plaintiff alleged that Shake Shack violated the Fair Workweek Law by failing to consistently: (1) provide employees with a good faith estimate of the hours, dates, times, and locations of employees’ expected regular work schedule; (2) provide predictable schedules with at least 14-days’ notice; (3) pay the required premiums when hourly workers work opening and closing shifts without at least 11 hours off in between; and (4) offer new shifts to current employees before hiring new employees. Shake Shack denies it violated the law.

The Court has approved the Settlement. The Court did not determine whether Shake Shack did anything wrong.

Who received a settlement payment from the settlement?

Eligible class members who timely returned valid claim forms were sent settlement payments.

Please cash your check by August 16, 2023 or it will be void.

How do I get a settlement payment?

To receive a settlement payment, you must be a Settlement Class Member and have completed and submitted a timely and valid Claim Form.

It is too late to submit a Claim Form now.

How was my check amount calculated?

Your check was calculated from pay and schedule records provided by Shake Shack. For tax purposes, your check will be treated as a premium payment and statutory damages, If your check is $600 or more, you will receive an IRS form 1099 in January 2024.

I need my check reissued. What should I do?

Is it too late to receive a settlement payment if I did not timely submit a claim form?

Yes, it is too late. If you did not previously complete and return a claim form by the deadline set by the Court, you are not eligible to receive a settlement payment. No exceptions can be made.
